1. Acceptance

These Terms of Use govern your access to and use of Snap Property Reports, including our websites, applications, reports, workspace features, exports and related services.

By accessing or using the service, you agree to these terms, our Privacy Policy, our AI/Report Disclaimer and, where applicable, our Professional-Use Terms. If you do not agree, do not use the service.

2. Eligibility

You must be legally capable of entering into a binding agreement to use the service. If you use the service for a business, trust, partnership, advisory practice or other organisation, you represent that you have authority to bind that entity.

3. Nature of the Service

Snap Property Reports provides software tools and AI-assisted research outputs designed to help users organise and accelerate property research. The service is informational only.

The service is not a substitute for legal, financial, credit, tax, valuation, building, planning, insurance, accounting or other professional advice, and does not create any adviser-client, agency, fiduciary or brokerage relationship.

4. Accounts and Access

Some features require sign-in. You are responsible for maintaining the confidentiality of your login, for all activity carried out under your account, and for ensuring account details remain accurate.

We may refuse access, require additional verification, suspend accounts or restrict features where reasonably necessary for security, abuse prevention, maintenance, legal compliance or dispute management.

5. Permitted Use

Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the service for your own internal personal or business purposes.

You must not:

  • copy, resell, sublicense or exploit the service as a bureau
  • scrape, reverse engineer, probe, benchmark or attempt to extract models, prompts, datasets or source code except as non-excludable by law
  • use bots, scripts or automation to overload, bypass limits or evade anti-abuse controls
  • upload unlawful, defamatory, infringing, malicious or deceptive material
  • use the service in a way that infringes another person's privacy, confidentiality, intellectual property or legal rights
  • remove or hide disclaimers, attribution, warnings or risk statements that accompany the service or report outputs where those notices are relevant to context

6. Your Inputs and Responsibility

You are solely responsible for all information, prompts, notes, instructions, client details, branding, uploads and other material you submit to the service.

You represent and warrant that:

  • you have the right to submit that material
  • doing so will not breach any law, confidence, privacy obligation, professional duty or third-party right
  • any decisions or actions taken using the service remain your responsibility

7. Third-Party Services and Data

The service may rely on third-party providers, including authentication, AI, analytics, hosting, mapping, security and infrastructure providers. We are not responsible for third-party services, sites, datasets, availability, errors or policy changes.

Property, planning, market and location information may be incomplete, outdated, inconsistent across sources or unavailable in real time.

8. Intellectual Property

We and our licensors own all rights, title and interest in the service, including software, workflows, branding, layout, prompts, databases, visual design and documentation, except for rights you own in your original inputs.

As between you and us, you retain ownership of material you submit. Subject to your non-excludable rights, you grant us a non-exclusive licence to host, copy, process, adapt, transmit and use that material as reasonably necessary to operate, secure, improve and support the service and comply with law.

9. No Warranties

To the maximum extent permitted by law, the service is provided "as is" and "as available". We do not warrant that the service will be uninterrupted, accurate, complete, secure, up-to-date, fit for any purpose or free from errors.

We expressly disclaim warranties, representations and conditions of any kind, whether express, implied, statutory or otherwise, except to the extent they cannot lawfully be excluded.

10. Important Consumer-Law Qualification

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

Where a non-excludable guarantee applies and the law permits us to limit our liability, our liability is limited, at our option, to the resupply of the services or payment of the cost of having the services supplied again.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or any loss of profits, revenue, goodwill, opportunity, data, business, contracts or anticipated savings.

To the maximum extent permitted by law, we are also not liable for any loss arising from:

  • decisions made or not made using the service or any report
  • property acquisitions, disposals, financing or negotiations
  • inaccurate, incomplete, delayed or unavailable third-party data or services
  • user error, misuse, unauthorised access or security incidents
  • downtime, outages, bugs, compatibility issues or model behaviour

To the maximum extent permitted by law, our total aggregate liability in connection with the service is limited to the greater of the amount you paid us for the relevant service in the 12 months before the event giving rise to the claim or AUD $100.

12. Indemnity

You indemnify us and our personnel against claims, losses, damages, liabilities, costs and expenses, including reasonable legal costs, arising out of or connected with:

  • your use of the service
  • your breach of these terms
  • your inputs, uploads, branding or client data
  • your breach of privacy, confidentiality, consumer, advertising, professional or intellectual property obligations

13. Suspension and Termination

We may suspend, throttle, restrict or terminate access immediately if we reasonably believe that you have breached these terms, created risk for us or others, used the service unlawfully, or where continued access is not commercially or technically viable.

On termination, provisions that by nature should survive will survive, including provisions relating to intellectual property, disclaimers, liability, indemnity, disputes and accrued rights.

14. Changes to the Service

We may modify, suspend or discontinue any feature, dataset, workflow, pricing model, free tier, export option or integration at any time without liability, subject to non-excludable rights.

15. Changes to These Terms

We may update these terms from time to time. The updated version will be posted on this page and apply from the stated "Last updated" date. Continued use after an update constitutes acceptance of the revised terms.

16. Governing Law and Forum

These terms are governed by the laws applicable in Australia and, to the extent permitted by law, the laws of the State or Territory of the operator's principal place of business. Subject to non-excludable rights, you submit to the non-exclusive jurisdiction of the courts of that place and any courts hearing appeals from them.
