Professional-Use Terms

1. Application

These Professional-Use Terms apply if you use Snap Property Reports in connection with a business, advisory practice, agency, brokerage, consultancy, buyer's advocacy, research service, client engagement or any other commercial or professional activity.

These terms supplement the Terms of Use. If there is any inconsistency, these terms prevail to the extent of the inconsistency for professional or commercial use.

2. No Professional Appointment

We provide software only. We are not appointed as your agent, contractor, adviser, sub-adviser, responsible manager, representative, fiduciary, broker or professional delegate.

Nothing in the service creates a retainer, partnership, joint venture, employment relationship or outsourced compliance function between you and us.

3. Your Responsibility for Client-Facing Use

If you use, export, rebrand, share or rely on outputs in connection with a client, lead, customer, investor, borrower, seller, buyer or stakeholder, you remain solely responsible for:

  • all client communications and recommendations
  • all legal and regulatory compliance obligations
  • reviewing and approving every output before it is used
  • ensuring outputs are not false, misleading, deceptive or incomplete in the circumstances
  • deciding what disclaimers, caveats, assumptions and source qualifications are required for the end user

4. No Reliance by Your Clients on Us

Your clients and end users are not our clients, customers or intended reliance parties merely because you use the service for them. No duty of care, advisory duty, fiduciary duty or direct contractual duty is owed by us to your clients or other downstream recipients unless we expressly agree otherwise in writing.

5. Authority to Submit Third-Party Information

You must only submit personal information, property information, instructions, notes or branding material where you have the necessary authority and legal basis to do so.

You are responsible for:

  • giving any required privacy notices to clients and contacts
  • obtaining any required consents or authorities
  • ensuring your collection, disclosure and use of third-party data is lawful
  • not submitting sensitive, restricted or confidential material unless you have determined it is appropriate and authorised

6. White-Label and Branding Use

If the service allows branding, workspace customisation or client-ready exports, that functionality does not transfer responsibility for the content to us. You remain responsible for any branded or white-labelled report you issue, including its wording, presentation, disclaimers and compliance position.

You must not present any output in a way that implies we endorsed or verified your final advice, compliance review or client recommendation unless we expressly agreed in writing.

7. Compliance With Professional and Consumer Obligations

You are solely responsible for ensuring your use of the service complies with all laws, codes and professional obligations applicable to you, which may include privacy, confidentiality, advertising, consumer, financial services, credit, property, agency, record-keeping, supervision, licensing and dispute-resolution requirements.

8. Mandatory Human Review

You must not rely on the service as an autonomous final-output system for client delivery, regulated advice or material transaction decisions. Human review by an appropriately qualified person is required before external use.

9. Record Keeping and Audit

You are responsible for maintaining any file notes, approvals, source verification, supervision records, client disclosures and audit trails required by your business, insurer, regulator, licensee or professional standards framework.

10. Prohibited Professional Uses

You must not use the service:

  • as a substitute for the independent professional judgment required of your role
  • to create documents you know or ought reasonably know are misleading or non-compliant
  • to fabricate sources, evidence, valuations, compliance checks or due diligence steps
  • in a way that suggests our outputs are licensed advice, valuations, certifications or legal sign-off

11. Indemnity for Professional Use

In addition to the indemnity in the Terms of Use, you indemnify us and our personnel against claims, losses, liabilities, costs and expenses arising from or connected with your professional or client-facing use of the service, including claims by your clients, counterparties, regulators, insurers, licensees, referrers or other downstream recipients.

12. Liability Cap and Exclusion for Professional Use

To the maximum extent permitted by law, we exclude liability for any professional, advisory, client, transaction, compliance, negligence or reliance loss arising out of your commercial or professional use of the service, subject to non-excludable rights.

Any liability we cannot lawfully exclude remains subject to the limitation provisions in the Terms of Use.
